For the last two months, Oliwia Puto – our Legal Trainee was working on her Overall Project, which was the creation of a chatbot “BenBot” for LexDellmeier. “BenBot” is a mobile app that aims to facilitate and accelerate the process of filing applications for the registration of an EU trademarks. In order to achieve this purpose, it collects from the users all information that the attorneys at LexDellmeier need to prepare such applications. We are delighted to announce that this project will officially go live around December 2020/January 2021. This means that in just a few months you will be able to download the app from AppStore and use it to receive information on matters related to trademarks, IP law etc., and to send information needed to apply for an EU trademark registration – 24/7! What makes us particularly excited about this project is that (as far as we know) LexDellmeier will be the first law firm in Germany to implement a Legal Tech solution of this kind. On 28 March 2018, the Directorate-General for Communications Networks, Content and Technology for the European Commission (DG CONNECT) published a Notice to Stakeholders stating that after the UK leaves the European Union on 30 March 2019, all domain name owners based in the UK will no longer be entitled to “.eu” top-level domains.

The World Intellectual Property Organization (WIPO) and the European Union Intellectual Property Organization (EUIPO) have recently published their statistics regarding information on applications and cases filed during the year 2017. On 20 February 2018, the General Court of the European Union (GC) upheld the previous decision of Board of Apeal of EUIPO (BoA) when it found the trademark “BEPOST” and the trademarks “POST” and “ePOST” to be sufficiently visually and aurally different to rule out a likelihood of confusion.

On 18 January 2018, the General Court of the European Union (GC) upheld the decision of the Board of Appeal in the case T-804/16. LG´s application for the EU word mark “Dual Edge” was found to lack distinctive character and was therefore refused to be registered by the EUIPO.

On 20 December 2017, the Court of Justice of the European Union (CJEU) gave its opinion on the “Champagner Sorbet” case. The Court stated the conditions of using the Protected Designation of Origin (PDO) for “Champagne” on a product which only contained 12% of Champagne.
